Terms of service(中文條款在英文條款之後)
In these terms and conditions, the "Company" will mean Koji Sake Limited and the "Customer" will mean any person, firm, company or body which places an order with the Company through this website (www.koji-sake.com).
Please read these terms and conditions carefully before using the site. By using the site or any part of it, you agree that you have read these terms and conditions and that you accept and agree to be bound by them.
[I] Confirmation of Age
It is illegal to sell alcohol to people under the age of 18. By placing an order, the Customer confirms that he/she is 18 years old or above. The Customer shall ensure that no person shall use his/her login to purchase alcohol products and a person aged 18 or above (identification required) must be present to take delivery or delivery shall be withdrawn and attempted at another time agreed.
[II] Orders
All tasting notes, product taste descriptions, general sake information, commentaries, advice and food pairing suggestions (collectively, the “Commentary”) are subjective opinions of the Company. The Company makes no representations as to the accuracy or the completeness of the Commentary and the Customers shall not rely on the Commentary in making any offer for purchases.
The Customer’s offer to purchase made through www.koji-sake.com are subject to acceptance by the Company. Acceptance by the Company shall be evident by the delivery of the sake to the designated address by the Company or its agent. Confirmation of order placement by e-mail shall not be regarded as acceptance of the Customer’s offer to purchase.
The Company reserves the right to:
reject the order in the event that any of the products or services requested are unavailable; and
limit sales and refuse to accept any order (or part of the order), including the right to decline sales to any Customers.
In the event that the Company is unable to fulfill any of the products or services in the Customer’s order we will notify you by phone or email before your requested delivery date.
All information presented on this website are subject to change without prior notice to the Customers.
[III] Registration
The Customer shall register before placing any order through this website. During the registration, the Customer shall:
provide us with accurate, complete and up to date registration information;
safeguard your username and password; and
authorise us to assume that any person using the site with your username and password is either you or is authorised to act for you.
The Company has the absolute discretion to refuse registration of a potential customer and to terminate, at any time, the registration of any customer for any reason whatsoever.
You must inform us immediately of any changes to the information that you provided so that we can communicate with you effectively.
[IV] Breakage
The Customer shall examine the goods immediately upon delivery for any deficiencies and/or damages.
In the event of a claim, the Customer shall:
not accept delivery;
request our agent/driver to return the goods to the Company; and
lodge a claim to our customer services sales@koji-sake.com as soon as reasonably practicable but within 2 working days in any event.
If the goods are not returned at the time of delivery, the Company shall have the discretion to refuse he Customer’s claim after delivery.
[V] Refund Policy
No return of goods shall be accepted, if any of the following conditions apply:
after 7 days of purchase without invoice or receipt; or
any of the original packaging has been damaged; or
in the sole opinion of the Company, the product has been or may have been opened, substituted or in any way tampered; or
the goods are glasswares and the Customer has acknowledged receipt of the goods;
the price of the sake is above HK$700 per bottle.
Refund will be credited into Customer's credit card account within 4 weeks upon confirmation.
[VI] Title & Non-delivery
The Company shall retain title in the products until full payment has been received.
All risks in the products shall pass to the Customer upon delivery.
In the event that:
the goods are non-deliverable within two weeks of purchase due to Customer's failure to notify the Company of change of address or the Company is otherwise unable to contact the Customer; or
the Customer refuses to take delivery of the goods and does not apply for a refund within 7 days,
then the Company has the right to dispose of the goods with no further notice to the Customer.
The Company shall have no liability to the customer in respect of disposal of the goods in such circumstances.
[VII] Payment
The Company accept payment by:
VISA, MasterCard and American Express through Paypal; and
Cash payment upon delivery.
All product prices listed are in HK dollars.
The upper limit of purchase on this website is $50,000 per transaction. For any purchase over the value of $50,000, please contact us at sales@koji-sake.com.
The Company reserves the right to change the payment terms for any order without prior notice.
[VIII] Delivery
The Company offers FREE delivery (single location only) for purchases over HK$1000 (net price). For orders under HK$1000, a delivery charge of HK$100 shall apply.
Orders are expected to be ship out within 2 business days after the order is received. Delivery would be the 1 or 2 days after shipment. Delivery during high season such as year end and Chinese new year may take 1 or 2 more days.
Delivery service is limited to Hong Kong, Kowloon and New Territories commercial and residential addresses only. Delivery is not available to outlying islands, restricted areas, hotel guest rooms, ports or marinas.
Delivery service will be suspended when typhoon signal No.8 or above or a black rain warning is hoisted. In this event, the Customers will be contacted to re-schedule delivery time.
Delivery service is only available to addresses of 4th floor or above when lift service is available. In the event of a lift breakdown the Company or its agent will make arrangements to deliver the goods at another time.
The Company reserves the right to charge an additional delivery fee if the Customer (or its agent) is not available to accept delivery at the nominated delivery time.
It is the responsibility of the Customer to notify the Company immediately of any change to their delivery address.
[IX] Others
The Company shall not be liable for any delay or failure in its performance caused by or resulting from acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failures, or any other causes beyond the control of Company.
These terms and conditions shall be governed by the laws of the Hong Kong Special Administrative Region, the People's Republic of China and the Customer and the Company agree to submit to the exclusive jurisdiction of the Hong Kong courts.
The Company may revise these terms and conditions at any time without prior notice. If any dispute arises, the Company’s determination shall be final.
Where these terms and conditions are available in Chinese, the English version is the governing version and shall prevail whenever there is a discrepancy between the two versions.
[X] Disclaimer
The Company and its associated companies, subsidiaries, employees, agents, contractors and any third party provider (collectively "Koji Sake") make no representation or warranty in relation to:
the completeness, quality, operation, use, accuracy, or timeliness of, or the fitness or use for any purpose of, koji-sake.com or the information (the “Information”) stored on or receivable through this or any other koji-sake.com server;
any goods or services accessed, offered or obtained through koji-sake.com or pursuant to the Information;
the access to koji-sake.com or the Information will be uninterrupted or does not contain any viruses, or contaminating or destructive properties.
The Customer shall not rely on the Information. Koji Sake shall not be liable for any damages, loss, costs or expenses arises, directly or indirectly, from the Customer’s reliance or use (whether authorized or not) of the Information or this website.
The terms and conditions set out in the Privacy Policy Statement is hereby incorporated by reference.

[I] 年齡確認
售賣酒精類飲品予18歲以下的人士為非法行為。訂貨代表該顧客確認自己年滿18歲或以上。顧客須確保其他人士不得使用其網頁登入戶口購買酒精類飲品,及確保收貨時必須由一名年滿18歲或以上人士(須提供適當證明) 收貨。如上述人士並不在場,本公司將會收回貨品並會嘗試於另一約定時間再行送貨。
[II] 訂單
所有試酒筆記、貨品味道說明、一般清酒資料、評論、意見及美食配對建議(統稱「有關評論」) 均為本公司的主觀意見。本公司就有關評論的準確性或完整性不作申述,顧客亦不可以有關評論作為訂購要求的倚據。
顧客透過www.koji-sake.com提出的訂購要求須被本公司接受才生効。由本公司或其代理人將清酒送往指定的地址便証實本公司接受了該訂購要求。確認收到訂購要求的電郵不可被視為訂購要求已被接受的証明。
本公司保留以下權利:
(a) 如任何訂購的貨品或服務未能被提供,拒絕該訂單; 及
(b) 限制銷售量及拒絕接受任何訂單(或該訂單的部分) ,包括有權拒絕售賣予任何顧客。
倘若本公司無法提供您訂單上的任何產品或服務,我們會於您所要求的交貨日期之前透過電話或電郵通知您。
本公司有權隨時更改本網站內的所有資料而不作另行通知。
[III] 登記
透過本網站訂貨前,顧客必須先登記。登記的時候,顧客須:
(a) 按要求提供給我們準確、完整及最新的登記資料;
(b) 確保妥善保存您的使用者名稱及密碼; 及
(c) 授權我們假設只有您或您授權的人士使用您的使用者名稱及密碼登入本網站。
本公司有絕對酌情權,基於任何原因,拒絕任何新客户之登記,及於任何時候終止任何已登記之客户。
如您所登記的資料有任何更改,須立即通知我們以確保我們能夠有効地聯絡您。
[IV] 貨物破損
顧客於收取貨品時必須檢查所訂購之貨品是否有不足及/或損毀。
如要申索,顧客須:
(a) 不收取貨品;
(b) 要求我們的代理人/司機將貨品退還本公司; 及
(c) 盡快在合理切實可行範圍內,但必須於兩個工作天以內,向我們的顧客服務部sales@koji-sake.com提交申索。
如在送貨時該貨品沒有被即時退還,本公司有酌情決定權拒絕顧客於收貨後才提出的申索。
[V] 退款保證
如有下列任何情況,絕不接受退貨:
(a) 送貨日起七日之後,沒有發票或收據; 或
(b) 任何原裝包裝經已損壞; 或
(c) 本公司單方面認為該貨品已被或可能已被打開、調換或被任何方式干擾; 或
(d) 該貨品為已被顧客確認收取的玻璃物品; 或
(e) 每瓶為港幣$700以上的清酒。
退款金額將於確認後起4星期內存入顧客支賬的信用卡戶口。
[VI] 所有權及不交付貨品
本公司保留貨品的所有權,直至有關貨品的價款全數結清為止。
貨品的所有風險在貨品送抵後轉移給顧客。
如果下列情況發生:
(a) 由於顧客沒有通知本公司更改地址,或本公司不能成功聯絡顧客,已購買之貨品無法成功派送達兩星期; 或
(b) 顧客拒絕收取貨品及不於七日內要求退款,
即,本公司有權處理該貨品,而無須再通知該顧客。
在上述情況下,本公司就該貨品的處理,無須向該顧客承擔法律責任。
[VII] 付款方法:
本公司接受下列付款方法:
(a) VISA卡, 萬事達卡及美國運通信用卡透過Paypal付款; 及
(b) 送貨時以現金付款。
所有貨品之列價均為港幣。
本網站的網上購物付款上限為每宗交易港幣$50,000。如顧客須要購買總值港幣$50,000以上的貨品,請與我們sales@koji-sake.com聯絡。
本公司保留權利於任何時間更改網上購物的付款方式而不作另行通知。
[VIII] 送貨服務:
凡購物滿港幣$1000 (折扣後價格) 或以上,即可享免費送貨服務(只限單一送貨地點)。惠顧低於港幣$1000,須付送貨服務費港幣$100。
訂單會在落單後1至2工作天處理,出貨後1至2天送達,請注意在高峯期例如年末或農曆年間,送貨或會需要額外1至兩天,敬請見諒。
*如訂單送交酒倉當天是假日,則下一個送貨日會在該假日後的第二個工作天。工作日定義為星期一至五,公眾假期除外。
送貨服務僅限於香港島、九龍及新界的商業及住宅地址。送貨服務不適用於離島、任何管制區域、酒店房間、港口或碼頭。
當8號烈風訊號懸掛或黑色暴雨警告生效時,送貨服務時間或會延遲,本公司將會聯絡顧客更改送貨日期。
四樓或以上的送貨地點必須有直達升降機才會提供送貨服務。如有任何升降機故障,本公司或我們的代理人將會更改送貨日期。
如顧客(或其代理人)未能於約定時間內收取已訂購之貨品,本公司將保留權利向該顧客收取額外的送貨費用。
送貨地址如有任何變更,顧客有責任即時通知本公司。
[IX] 其他
如由於天災、火災、水災、意外、暴亂、戰爭、政府介入、禁運、罷工、勞工問題、設備故障或任何本公司不能控制的情況而引至延遲或未能提供服務,本公司均不會承擔任何責任。
本條款及條件將受中華人民共和國香港特別行政區(「香港」)法律所管轄及按照香港法律解釋。顧客及本公司均同意香港法院對其具有專有司法管轄權。
本公司有權隨時修改本條款及條件,而無須事前通知。如有任何爭議,本公司的決定為最終的決定。
倘若本條款及條件有中文譯本,如中、英文本之文義有異,應以英文本為準。
[X] 免責聲明
本公司及其相聯公司、附屬公司、僱員、代理人、承辦商及任何第三方供應者(下統稱「Koji Sake」)不對下列事宜作出申述或保證:
(a) koji-sake.com或本伺服器或任何其他koji-sake.com伺服器所儲存或取得的所有資料(下稱「有關資料」)的完整性、質量、運作、使用、準確性或時效,或對任何目的之適合性或用途;
(b) 透過koji-sake.com或根據有關資料索取、提供或獲得之任何貨品或服務;
(c) 瀏覽koji-sake.com或有關資料時不受干擾,或資料正確無誤,或有關資料不含任何電腦病毒或不具污染性或破壞性;
顧客不可以有關資料作為倚據。Koji Sake對顧客因倚據或使用有關資料或本網站而蒙受的任何間接或直接的損害、損失、費用或開支,均不承擔任何責任。
